AES Export Processing – Enforcement with Penalty

Dear Valued Customer:

From 1 February 2009, U.S. Customs Border and Protection (CBP) will impose penalties for all export cargo on vessels that load at U.S. ports, which are in violation of the Mandatory Automated Export System (AES) Final Rule published by the U.S. Bureau of the Census on 2 June 2008.

Under the rule, exporters must file Electronic Export Information using AES and provide proof of an AES Citation Number (ITN), Exemption Legend or AES Post Departure Citation to the carrier 24 hours before the cargo is loaded.

As a reminder, APL requires written submission of the Citation or Legend, 24 hours prior to the prevailing port cargo cutoff.

APL channels for submission of ITN

The USPPI can submit ITN/exemption/exclusion legend to APL:

  • By fax (Fax: +1-800-678-3687)
  • By web submission. Log on to APL HomePort portal and simply click on the "US Export ITN" button.
  • By EDI using N9/ED (preferred) or C8/38 segment in the 304 (Shipping Instructions) message.

With the enforcement penalty coming into effect, failure to provide your ITN/exemption/exclusion legend by the prescribed cutoff will result in your cargo being rolled at the port.

In addition, a roll fee of US$200 per bill of lading will be imposed on Transpacific trade cargo and US$50 per bill of lading will be set for Transatlantic and Latin American freight. Any handling, port demurrage or storage charges incurred as a result of the cargo being rolled will also be charged to the exporter.
