ILA Customer Advisory - Term 10

Customer Advisory Others

Dear Valued APL Customer,

As of today, the situation remains unchanged regarding the ongoing negotiations between the International Longshoreman Association (ILA) and the United States Maritime Alliance, Ltd. (USMX). We will continue to keep you informed as we learn more.

APL Operations & Contingency Preparation

APL has proactively implemented contingency plans and remains fully committed to support customers by addressing potential disruptions through flexible and effective solutions.

Due to the anticipated impacts of an impending strike, APL reserves its right to invoke Term 10 of its Bill of Lading and may pass through any additional operational costs associated with cargo re-routing or vessels delayed due to a strike to the cargo interests.

Additionally, pursuant to APL’s tariff, please be advised that for the duration of a strike during any time the terminal is closed, free time and demurrage will be calculated and assessed as follows:
• Free time will be extended for containers within free time at the time of strike for a period equal to that of the terminal closure.
• Demurrage will be suspended for containers in demurrage at time of strike for the duration of the terminal closure and will resume assessment at the rate tier level in which assessment was suspended.
• Detention free time will be extended for containers within free time at the time of strike for a period equal to that of the terminal closure, and detention will be suspended for containers already in detention at the time of strike for the duration of the terminal closure and will resume assessment at the rate tier level in which assessment was suspended.

Please review APL's Tariff Rule APLU 100 Rules 100, 200, and 300 for further information on applicable demurrage and detention charges.

Thank you for your continued support. Should you have any questions or concerns regarding the above, please contact your local APL sales representative.  For current schedule activity please visit our website at https://www.apl.com/

Sincerely,
APL
